A certificate cerrtifying a right for reinstatement of the citizenship of Lithuania

A certificate certifying a right for reinstatement the citizenship of Lithuania is a document certifying the facts usable as a base for reinstatement of citizenship of Lithuania and provides a right for reinstatement of the citizenship of Lithuania to the person. The said document facilitates the process of reinstatement of citizenship of Lithuania and is issued for a termless period, so its bearer may apply for reinstatement of citizenship of Lithuania and use the document at any time.

A certificate certifying a right for reinstatement the citizenship of Lithuania may be issued to a person that is entitled to apply for reinstatement the citizenship of Lithuania according to legal norms of Lithuania and shall be a base for such reinstatement. For reinstatement of the citizenship of Lithuania, may apply persons who were citizens of Lithuania prior to 15 June 1940 or descendents of such persons, i.e. to children, grandchildren and great-grandchildren of persons who were citizens of Lithuania prior to 15 June 1940.

The citizenship of Lithuania of a person prior to 15 June 1940 may be proved by the following documents:

1. Lithuanian passports issued before 15 June 1940;
2. Documents certifying military service of the person in Lithuanian army or civil service in Lithuania;
3. Certificates of Birth or other documents where the citizenship is specified;
4. Any certificates issued in Lithuania before 15 June 1940 or certificates issued on the base of documents issued before 15 June 1940.
If the above-listed documents are absent, documents on education, employment or living in Lithuania issued before 15 June 1940 shall be provided.

Prior to applying for a certificate certifying a right for reinstatement the citizenship of Lithuania, the required documents shall be collected. If necessary, relevant requests shall be sent to Lithuanian archives or other institutions. If documents are executed in a language other than Lithuanian they shall be translated into Lithuanian. Copies of the documents shall be notarized. Documents issued in foreign states shall be certified by Apostille or legalized, unless otherwise is provided by international treaties of Lithuania or legal norms of the European Union.

The documents shall be submitted to a diplomatic mission or a consular institution in a foreign state or to the Migration Department in Lithuania; alternatively, they may be sent by mail or through a courier.

The documents to be submitted include:

1. The application completed in Lithuanian;
2. The passport;
3. The documents certifying that the person was a citizen of Lithuania prior to 15 June 1940; or
4. The documents certifying that the person is a descendant of a person who was a citizen of Lithuania prior to 15 June 1940;
5. The documents certifying the family connections;
6. A document evidencing the change of name or surname where such personal data have been changed;

7. 2 photos of the person (40 x 60 mm). 

The Migration Department shall pass a decision on issue a certificate certifying a right of the person for reinstatement the citizenship of Lithuania within 6 months from the date of reception of the documents by the Migration Department.

The applicant may take the certificate certifying a right of the person for reinstatement the citizenship of Lithuania at the diplomatic mission or the consular institution of the foreign state or at the Migration Department or Migration Service in Lithuania.

Regardless of which state they reside in now, persons who held Lithuanian citizenship before 15 June 1940, or their descendants, most often prefer to restore Lithuanian citizenship. In this context, it is significant to obtain a certificate attesting to the person’s right to reinstate Lithuanian citizenship.

 

What is a certificate attesting to the right to reinstate citizenship of the Republic of Lithuania?

It is a document that confirms the existence of the facts forming the basis for reinstatement of Lithuanian citizenship and which grants a person the right to reinstate Lithuanian citizenship. Holding this document greatly facilitates reinstatement of Lithuanian citizenship – the process is faster and easier. This certificate is issued for an indefinite period of time, therefore, the person receiving it can apply for reinstatement of citizenship forthwith or later within an indefinite period of time.

 

Who is provided with a certificate attesting to the right to reinstate citizenship of the Republic of Lithuania?

If the reinstatement of Lithuanian citizenship is relevant to you, you will need this document. Persons who have grounds to reinstate Lithuanian citizenship can apply for it. This group covers persons who held Lithuanian citizenship before 15 June 1940, or who are descendants of such persons, i.e., children, grandchildren, great-grandchildren.

The Lithuanian citizenship held prior to 15 June 1940 must be evidenced by documents. This fact can be approved by the following documents:

  1. Lithuanian passports issued before 15 June 1940;
  2. Documents attesting to the person’s service in the Lithuanian Armed Forces or employment in the civil service;
  3. Birth certificates or other documents containing reference to Lithuanian citizenship held by the person concerned;
  4. Certificates issued before 15 June 1940 in Lithuania or certificates issued on the basis of documents issued prior to 15 June 1940.

 

If none of the aforesaid documents are available, then documents concerning studies, job, and life in Lithuania before 15 June 1940, as well as other documents are required.

 

Receipt of a certificate attesting to the right to reinstate citizenship of the Republic of Lithuania: document collection procedure

In order to apply for this certificate, certain documents must be collected. If there is a need, requests are submitted to Lithuanian archives and other institutions. If documents were drawn up not in Lithuanian, their translation into Lithuanian must be carried out. Copies of these documents must be certified by the notary. The documents issued by foreign states should be legalized or certified with a certificate (Apostille), unless the international treaties of the Republic of Lithuania or the legal acts of the European Union provide otherwise.

The collected documents must be filed to the Lithuanian consular office in foreign states or to the Migration Department in Lithuania.

 

What documents should be submitted?

In order to obtain a certificate attesting to the right to reinstate citizenship of the Republic of Lithuania, the following documents must be provided:

  1. Application drawn up in Lithuanian; 
  2. Passport; 
  3. Documents confirming that the person held Lithuanian citizenship before 15 June 1940 (if the person who had Lithuanian citizenship applies himself), or documents confirming that the person’s parents, grandparents or great-grandparents held Lithuanian citizenship before 15 June 1940 (if the application is filed by the descendants of a person who had Lithuanian citizenship);
  4. Documents proving kinship; 
  5. Documents confirming change of name and surname, if such personal data was changed; 
  6. 2 personal photos (40 x 60 mm).

 

When is a decision on issuing a certificate made?

The decision of the Migration Department as to the issuance of a certificate attesting to the right to reinstate citizenship of the Republic of Lithuania is made within 6 months from the date of receipt of the documents at the Migration Department.

The certificate can be collected at one of the institutions that were mentioned hereinbefore as places where documents can be submitted.
