Granting the citizenship of Lithuania according to the simplified procedure

The institute of the simplified procedure of granting the citizenship of Lithuania is applicable to persons of Lithuanian origin: it provides them a right to become citizens of Lithuania upon exclusion of the naturalization process. A person may apply for granting the citizenship of Lithuania according to the simplified procedure, if he (she) is of Lithuanian origin and has the relevant evidences. According to provisions of Lithuanian legal norms, a person of Lithuanian origin is considered a person whose parents and grandparents or at least one of them are or were Lithuanians, that believes to be a Lithuanian and declares the same by an affidavit. A citizenship of Lithuania may be granted according to the simplified procedure to a person of Lithuanian origin that never was a citizen of Lithuania up to present time. In case of granting the citizenship of Lithuania according to the simplified procedure, the person should renounce his/her citizenship of the foreign state.

The documents for granting the citizenship of Lithuania according to the simplified procedure shall be submitted to the President of Lithuania via the Migration Department, a Migration Service or a diplomatic mission/a consular institution of Lithuania in a foreign state:

1. The application;
2. The passport;
3. The evidences of Lithuanian origin of the applicant;
4. The document certifying that the applicant is not a citizen of another state;
5. A declaration of the applicant on renouncing the citizenship of the other state after granting the citizenship of Lithuania,
6. A certificate on absence of convictions.
7. A document evidencing the change of name or surname where such personal data have been changed.

The documents shall be executed in Lithuanian. If documents are executed in a language other than Lithuanian they shall be translated onto Lithuanian. Copies of the documents shall be certified according to the procedure provided in laws. Documents issued in foreign states shall be certified by Apostille or legalized, unless otherwise is provided by international treaties of Lithuania or legal norms of the European Union.

The Migration Department shall transfer the application for granting the citizenship of Lithuania according to the simplified procedure and the enclosed documents with appendices to the Citizenship Board under the Ministry of Justice of Republic of Lithuania no later than within 3 months. The citizenship of Lithuania shall be granted to the person by a decree of the President of Lithuania and the person shall swear an oath of allegiance to Lithuania. After the oath, the rights and duties of a citizen of Lithuania appear for the person.

Granting the citizenship of Lithuania according to the simplified procedure

Persons who have never held Lithuanian citizenship, but are of Lithuanian descent, can acquire citizenship of the Republic of Lithuania under the simplified procedure, regardless of whether they reside in Lithuania or in another state. These persons avoid the requirement to have resided in Lithuania for a certain period of time and to pass examinations of the fundamentals of the Constitution of the Republic of Lithuania and of the state Lithuanian language.

Acquisition of the Lithuanian citizenship is usually not an easy and very urgent process. Obtaining Lithuanian citizenship can take six months, a year or even longer. However, in some cases it is possible to grant Lithuanian citizenship under the simplified procedure. What is this process and when is it possible?

 

Granting of Lithuanian citizenship under the simplified procedure: what is it, who is it valid for?

The institute of granting of Lithuanian citizenship under the simplified procedure is applied to persons of Lithuanian descent and grants them the right to acquire Lithuanian citizenship without applying the naturalisation process. A person can apply for Lithuanian citizenship under the simplified procedure if he is of Lithuanian descent and has documents confirming this fact.

Who is a person of Lithuanian descent? Pursuant to the Lithuanian legislation, this is a person whose parents, grandparents or at least one of them are or were Lithuanians, who considers himself Lithuanian and declares this in a written statement.

Lithuanian citizenship can be granted under the simplified procedure to a person of Lithuanian descent who did not hold Lithuanian citizenship until now. It is crucial that upon acquisition of Lithuanian citizenship under the simplified procedure, a person must renounce the currently held citizenship of a foreign state.

 

Acquisition of Lithuanian citizenship under the simplified procedure: documents

Documents concerning granting of Lithuanian citizenship under the simplified procedure should be submitted to the President of the Republic of Lithuania through the Migration Department, Migration Service or through the Lithuanian diplomatic mission or consular office abroad.

 

Documents which must be submitted:

  1. Application;
  2. Passport;
  3. Documents confirming Lithuanian descent;
  4. Document approving that a person is not a citizen of another state;
  5. Statement on renunciation of citizenship of another state after the Lithuanian citizenship is granted;
  6. Criminal record certificate;
  7. Document confirming the change of name or surname, if such personal data has been changed.

All documents must be drawn up in Lithuanian. If documents are drawn up in a foreign language, their translation into Lithuanian is obligatory. Copies of documents must be certified in accordance with the procedure established by law. The documents which are issued by foreign states should be certified with a certificate (Apostille) or legalised, unless the international treaties of the Republic of Lithuania or the legal acts of the European Union stipulate otherwise.

 

How long does the process take?

After an application for granting of Lithuanian citizenship under the simplified procedure is filed, the Migration Department shall, no later than within 3 months, submit the documents and their annexes to the Citizenship Affairs Commission for consideration. Lithuanian citizenship is granted by decree of the President of Lithuania. After granting Lithuanian citizenship to a person, such person must take an oath of allegiance to the Republic of Lithuania. Having taken the oath of allegiance, the rights and duties of a Lithuanian citizen become binding on the person.
